III. Storage period

CLAAS stores your personal data only for as long as necessary in order to fulfil the purpose for which it is collected and processed. Where necessary, CLAAS shall store your data for the duration of the business relationship. This includes, but is not limited to, the initiation and execution of the contract.

Furthermore, CLAAS stores your personal data if and as long as this is required to fulfil contractual or legal obligations. We thus process your data to fulfil commercial or fiscal verification and retention obligations. The stipulated retention and documentation periods are six years in accordance with the commercial requirements under Section 257 of the German Commercial Code (HGB) and up to ten years under the fiscal requirements pursuant to Section 147 of the Fiscal Code of Germany (AO), provided the data is no longer required for tax purposes (e.g. because a company audit is ongoing). The periods start at the end of the calendar year in which the record was created.

If the data is no longer required to fulfil contractual or legal obligations, it will be regularly erased, unless you have given CLAAS consent to process your data and/or further processing is required based on CLAAS' legitimate interests, for example to win back customers and defend against legal claims in legal disputes. In the case of data processed to defend against legal claims in legal disputes, the storage period shall also be based on the legal limitation periods. In accordance with Sections 195 et seq. of the German Civil Code (Bürgerliches Gesetzbuch, BGB), these are up to 30 years, with the regular limitation period lasting three years, starting at the end of the calendar year in which the claim arises. In this case, processing shall be limited, i.e. limited to the minimum scope required for the claim and blocked for other purposes.

The provision above does not apply insofar as the Separate Data Privacy Statement specifies otherwise.

IV. Categories of recipients

•    Carefully selected service providers. Service providers we engage, who support us in the performance of the business relationship, are granted access to the data. These companies operate in the following categories: Hosting providers, data management, software as a service, e-mail services, IT services (e.g. maintenance and support, data migration), consulting, service providers in the first, second and third level support, call centre services, customer administration, lettershops, marketing, media technology, telecommunications, customer relations management and lead management, tracking service providers, web agencies, compliance, disposal services (e.g. document shredders), companies who perform analyses for us, financial service providers, shipping and logistics services, printing services, technology service providers (e.g. for hardware and accessory parts). If any additional categories of service providers are employed, please refer to the relevant Separate Data Privacy Statement.

•    Transfer to third parties. We shall also transfer your data to third parties if this is permitted by legal or contractual provisions and/or you have given your consent. On this condition, the Data can be transferred to the following categories of recipients: Public bodies and institutions (such as the public prosecutor's office, police, tax authority, data protection supervisory authority) to process official requests, provided that this is in your interest or we are legally obligated to do so. The legal basis for this is Article 6(1f) or 6(1c) GDPR.

•    Data transfer within the CLAAS Group. We shall transfer your data to other companies within the CLAAS Group or grant them access to your data. Insofar as this is required for administrative purposes, this shall be based on our legitimate interest in internal administrative purposes and group reporting. The legal basis for this is Article 6(1f) GDPR. If this is required to prepare for an agreement initiated by you or to fulfil contract-related obligations, or if you have given your consent, the legal basis is Article 6(1b) or 6(1a) GDPR. If we are legally entitled to do this, the legal basis arises from Article 6(1c) GDPR. We refer to the Separate Data Privacy Statement for any data transfer to third parties beyond the scope described here.

•    Third parties with whom we have an ongoing business relationship. If this is required to prepare for a contract or to fulfil contract-related obligations, or if you have given your consent, the legal basis is Article 6(1b) or 6(1a) GDPR. If we are legally required to do this, the legal basis arises from Article 6(1c) GDPR.

V. Transfer to third countries

If we transfer your personal data ourselves or via service providers to countries based outside the European Union, we shall comply with the relevant particular requirements of Article 44 et seq. GDPR and our service providers shall also undertake to comply with these regulations. This level of security is guaranteed in particular on the basis of an adequacy decision by the European Commission or with suitable guarantees in accordance with Article 46 GDPR.

Data will be transferred to third countries (countries outside the EU or the European Economic Area – EEA) if, for example, this is

•    necessary to fulfil a contract to which you are a party or in response to your enquiries.
•    necessary to safeguard our legitimate interests,
•    prescribed by law, or if you have given us your consent.
•    carried out during processing where service providers are involved.

If there is no European Commission decision for the country in question as to a level of data protection that is appropriate for European data protection requirements, we shall enter into corresponding contracts to ensure that your rights and freedoms are suitably protected. A contract of this kind ensures that a suitable level of data protection exists at the data recipient, especially through the agreement of the European Union's standard contractual clauses with the recipient. Otherwise, we can also perform a data transfer based on your express consent. You can withdraw your consent with future effect at any time, see Section A.VI. We will be happy to provide you with more detailed information free of charge on request. Please use the aforementioned contact details for this purpose.

Where we permit the recipient to process data without a suitable level of data protection based on your consent alone, please note the following risks: There may not be sufficient measures in place to protect your personal data appropriately; there is no data protection supervisory authority; the implementation of your data protection rights of the data subject is impeded or has been disregarded; there is no control over the further processing of data by and transmission of data to third parties.

Any further information required can be found in our Separate Data Privacy Statement.

VI. Obligation to provide personal data

Unless specified otherwise in the Separate Data Privacy Statement, you are not legally or contractually required to provide your data.

VII. Rights of the data subject

In accordance with Article 15 GDPR, you have the right to obtain information about the data that we hold that relates to you. If incorrect personal data has been processed, you have the right to rectification of your data in accordance with Article 16 GDPR. If the legal requirements apply, you can request erasure or restriction of processing and submit an objection to data processing (Articles 17, 18 and 21 GDPR). In accordance with Article 20 GDPR, you can exercise the right for data portability for data that is automatically processed on the basis of your consent or under a contract.

Information regarding your right to object according to Art. 21 GDPR

1.    You have the right to object, on grounds relating to your particular situation, at any time to the processing of personal data concerning you which is based on Article 6(1) 1 f GDPR (data processing based on a balancing of interests).

If you exercise your right to object, CLAAS shall then cease processing of your personal data unless CLAAS can provide compelling legitimate reasons for doing so which override your interests, rights and freedoms, or unless the processing is used to assert, exercise or defend legal claims.

2.    CLAAS processes your personal data for the purposes of direct marketing. You have the right to object to the processing of your personal data for the purpose of this type of marketing at any time.

If you object to your data being processed for the purposes of direct marketing, CLAAS shall cease using your personal data for these purposes.

Your objection can be submitted in any form and should be addressed to the following where possible:
privacy@claas.com

Right to withdrawal of your consent pursuant to Art. 7(3) GDPR

If you have given your consent for your personal data to be processed, you have the right to withdraw your consent at any time. Withdrawing your consent does not affect the lawfulness of the processing of data on the basis of your consent before the time at which consent was withdrawn.

Consent can be withdrawn in any form. You can use the contact details provided in Section A.II. for this purpose. Should CLAAS provide any further options for exercising your right to withdraw consent (e.g. an unsubscribe link in any newsletter e-mail), you will be informed of these in the Separate Data Privacy Statement.

You can exercise your rights vis-à-vis CLAAS using the contact details provided under Section A.II.

If you believe that data is being processed in violation of data protection regulations, you have the right to lodge a complaint with a data protection supervisory authority of your choice. (Article 77 GDPR).

You can of course also submit a complaint to the CLAAS data protection officer at any time (privacy@claas.com).

If you wish to exercise your data protection rights of the data subject, we will process your data in order to fulfil our legal obligations in accordance with Article 6(1c) GDPR in conjunction with Articles 15–22, 12(3–6) GDPR and Article 7(3) GDPR. This includes the processing of your data for the purpose of unequivocal identification of the data subject of a data processing activity, and the request for additional information to confirm identity. We do this on the basis of our legal obligation laid out in Article 12(6) GDPR. This includes the transfer of data to the data recipients within the meaning of Article 19 GDPR, as far as requests for the rectification of data, erasure or restriction of processing (Articles 16, 17(1), 18 GDPR) are concerned, and any related communications to these recipients (Article 19 GDPR) or to you as the data subject (Article 12 GDPR).

B.    Specific data protection information: Invitation and provision of the portal for registration

I.    Registering for the event via an event platform

If you register for the event via the event platform, you will need access to our event platform in order to complete your registration. You will receive your login details as part of the invitation. For the purposes of registration, CLAAS processes your electronic identification data (e.g. username and password).
When you log in using your login details, CLAAS verifies whether you are indeed a registered user. To do this, CLAAS processes your electronic identification data as well as technical documentation and log data. Once verification is successful, you will be granted access to the platform.

When you register on the platform, you are required to provide us with the relevant personal identification details (e.g. first name and surname), contact details (e.g. email address, telephone number, postal address) and company details (e.g. name of the organisation/company), as well as any other personal data required for the specific event registration. The data required to process your registration is marked as mandatory with an asterisk (*). In addition, you may voluntarily provide us with further data. CLAAS processes the personal data you provide to us via the platform for the purposes of registering you for and organising the event.

The legal basis is Article 6(1), first sentence, point (f) of the GDPR. The aforementioned purpose also constitutes our legitimate interest in processing your personal data.

II.    Collecting feedback
Immediately after our event has taken place, we will contact you once by email to gather your feedback and views on the event. This helps us to understand how satisfied you were with the running of the event, the content and the organisation.
The processing of your data for this purpose is based on Article 6(1)(f) of the GDPR (legitimate interest). Our legitimate interest lies in the continuous optimisation and needs-based design of our events. Your feedback enables us to improve the quality of our future events, tailor content even more closely to participants’ interests and make organisational processes more efficient.

C.    Marketing communications

If you have given us your consent to receive marketing communications when registering for the event, CLAAS Vertriebsgesellschaft1 (CLAAS KGaA mbH, CLAAS Global Sales GmbH, CLAAS Service and Parts GmbH, 365 FarmNet GmbH, CLAAS S.A.S, CLAAS E-Systems GmbH and CLAAS partners2 (hereinafter collectively referred to in this section as ‘the parties’) will use your data for this purpose.

Marketing communications include the CLAAS brands as well as third-party products distributed by companies within the CLAAS Group or by the CLAAS Partner, provided that these are products which complement CLAAS brand products or support their function (e.g. soil cultivation equipment, fertilisation, fertiliser technology, sowing technology, crop protection, farm management software). Contact will be made via the channels specified in the declaration of consent (e.g. post, email including newsletters, telephone/messaging services, push notifications, e.g. on websites or apps).

The legal basis for data processing is your consent, Article 6(1), first sentence, point (a) of the GDPR. You may withdraw your consent at any time with effect for the future; see Section A.VI. For marketing communications by post, the legal basis is Article 6(1), first sentence, point (f) of the GDPR.

For this purpose, the parties jointly process the following data:

-    personal identification details (e.g. surname, first name, address, CLAAS ID, title and role within the business, date of birth)
-    contact details (telephone number, email address)
-    farm details (name of the farm, address, main focus of the farm, farm size, fleet information, customer number, farm history (e.g. date of purchase or first use of your machine), turnover data, information on activities carried out (e.g. customer visits, product demonstrations),
-    information and analyses regarding interests and user behaviour (e.g. product interest, customer interest, preferred or selected communication channels, investment or purchase interest, information on products purchased or hired and services used (e.g. test drives, machine demonstrations, events, platforms such as CLAAS connect, applications, financing), customer history, sales data, information on opens, clicks and bounces from newsletters, apps, websites and social media channels, information lawfully obtained about individuals through, for example, customer needs and potential analyses – such as possible times when you may require a new machine, spare part or service, campaign history and response to direct marketing measures, feedback from customer satisfaction surveys)
-    machine data (machine master data, machine performance data and machine operational data, i.e. machine number and associated attributes such as manufacturer, product category, product group, product classification, model, machine type, equipment, configuration, hectares worked, number of bales produced, number of loads transported, operating hours)
This refers to data which the parties collect in conjunction with your marketing consent or for the purposes of direct marketing, or data which you provide to one of the parties in the course of the business relationship, or which arises from your use of the products, services or offerings of the aforementioned parties. The parties combine this data to create a user profile about you and assign it to your profile in our database (CRM). The parties use the data collected in this way and the information obtained to determine which information and offers are most likely to be of interest to you, for the purpose of contacting you for marketing purposes. The aim is to tailor our marketing communications to your interests and to optimise our offers for you.

2 The relevant CLAAS partner (e.g. the authorised dealer you have selected, the importer responsible for your area)

In individual cases and only after careful consideration, the parties may contact you for promotional purposes relating to the CLAAS brand (e.g. to offer additional services, to promote products and services, to invite you to events such as product launches, market and opinion research, customer satisfaction surveys) as well as third-party products distributed by companies within the CLAAS Group or by the CLAAS partner, provided that these products complement the CLAAS brand’s products or support their function (e.g. soil cultivation equipment, fertilisation, fertiliser technology, sowing technology, crop protection, farm management software), even without your marketing consent. The legal basis is Article 6(1), first sentence, point (f) of the GDPR. A prerequisite for direct marketing based on legitimate interests is that the applicable legal requirements are met and that you have not objected to the processing of your data for the purpose of receiving advertising, whilst being aware of your right to object under Article 21 of the GDPR (see also Section A.VI. of this privacy notice).

The legal basis for the storage of technical and specialist documentation and log data for the purpose of documenting your consent is Article 6(1), first sentence, points (c) and (f) of the GDPR. Marketing communications are generally carried out by service providers (e.g. marketing agencies, lettershops, IT service providers, CRM providers, messaging service providers), who act as data processors. These also include service providers based in a third country, including the USA and the UK; see Section A.IV. (Transfers to third countries).

D.    Survey conducted as part of a customer consultation

If you take part in a survey as part of a customer meeting, your personal identification details (surname, first name) will be recorded by scanning your name badge, so that the survey can be carried out on the event platform and linked to your data. The customer meeting is conducted by the sales representative for the purpose of initiating a contract. Following the meeting, you, as a prospective customer, will receive a thank-you email from the event portal containing a voucher code which entitles you to a discount when you enter into a purchase contract. The legal basis for the processing is Article 6(1)(b) of the GDPR.

IV.    Transfer to third countries

When your recordings are published on the channels specified in Section B. I., your data will be transferred to third countries. If you consent to the processing of your data, this expressly includes your consent to the transfer to third countries. We would like to point out that the following risks exist in this regard: there may not be sufficient regulations in place to adequately protect your personal data, there may be no data protection supervisory authority; the enforcement of your data subject rights may be impeded or disregarded; and there may be no control over the further processing and transfer of the data to third parties. The legal basis for the transfer of personal data to third countries is Article 49(1), first sentence, point (a) of the GDPR, based on your consent. You have the right to withdraw your consent at any time, informally and without giving reasons, with effect for the future; see Section A. VII. Withdrawal of consent does not affect the lawfulness of processing carried out on the basis of your consent up until the time of withdrawal.
If your personal data is published on the internet, it may be accessed worldwide. CLAAS has no control over this.

V.    Retention period

You have the right to withdraw your consent at any time. Your footage will then be deleted from the media listed in Section B. I.

If footage of you is published on the internet, it is possible that it may still be found via specialised search engines (e.g. www.archieve.org) even after it has been deleted. CLAAS has no control over this.
